City pulls plug on late fee

Councilman asks to extend committee member’s term

For the second time in a row, the issue of a late fee on a water bill took up most of the discussion at the Oct. 19 Canfield City Council meeting.

The request was to wave a late fee for 535 N. Briarcliff Drive.

The original request was made after the resident discovered a mistake and came in one day after the deadline and was charged a late fee of $46.

"The good payment history is there and the timeliness in taking care of it," Councilman John Morvay said.

Mark Fortunato, city attorney, said if council waves the late fee, it could open it up for others to pay late and get the late fee waved.

"What happened to the concept of paying it when it is due," Councilman Chuck Tieche said. "I think we are getting into an area where we shouldn't be."

A discussion was held into the matter and it was discovered there is no specific language in place to allow for the waving of fees in the city charter. One consideration was to put specific guidelines in place to allow fees to be waved if there was a good payment history and it was the first time.

The decision was made to table the issue until the first December meeting to give Fortunato a chance to look into wording on the subject of waving fees. Once the wording were in place, council could decide on the issue.

On a different matter, Councilman Joe LoCicero asked his fellow councilmen to extend the term for Debbie Roman on the Design Review Committee. He said she has special knowledge that is neded on that committee and her term limits are up.

The city charter allows boards and committees to keep one person who has special knowledge or expertise.

LoCicero also asked that the city establish standards for the committee to work with.

"There are no (design) standards for the city of Canfield," LoCicero said.
